29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about July 13, 2021, at the jobsite, an employee was observed operating a forklift truck and was not trained or evaluated by the employer.  Employees were exposed to struck by hazards.

This exposed the employees to a fall hazard.

29 CFR  1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:  On or about  July 13, 2021, at the jobsite, the employer did not ensure toe boards were erected along all edges of the scaffold platforms to prevent debris and/or materials from being kicked off of the edge.  Employees were observed working in areas below the scaffold and were exposed to the falling objects.

29 CFR  1926.451(e)(1):  When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  On or about July 13, 2021, at the jobsite, the employer did note ensure a safe means to access the scaffold was provided to employees using the scaffold.  The employees were observed climbing the scaffold end frames to access the scaffold platform and were exposed to a fall hazard.

29 CFR  1926.451(g)(1):  Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:  On or about July 13, 2021, at the jobsite, the employer did not ensure employees were protected from falling when working from the fourth and third levels of a 4-tier scaffold.  The scaffold did not have guardrails installed and the employees were exposed to fall hazards.
