OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were potentially exposed to chemical and/or fire hazards from an improperly designed, installed and maintained anhydrous ammonia refrigeration system:  Company:  The Machine room and equipment related to the anhydrous ammonia refrigeration system was not designed, installed and maintained in accordance with generally accepted and good engineering practices such as those contained in the International Institute of Ammonia Refrigeration (IIAR) standards.    Machine Room:  On, or about, July 11, 2021, the entire charge of the closed loop anhydrous ammonia system was released due to a seal leak in a reciprocating compressor.  The following deficiencies were observed:  1.	The employer had not implemented a program of regular, documented inspection, testing and maintenance procedures for components of the anhydrous ammonia system.  The employer performed daily, weekly and yearly visual inspections that included lubrication and basic fluid maintenance, but the employer had not implemented a program of more detailed tests, inspections and maintenance to ensure the integrity and proper operation of the components of the refrigeration system such as, but not limited to, compressors, vessels, piping, pressure relief valves and safety systems.    2.	The employer had not ensured that the design and installation of the Machine Room and refrigeration equipment met industry guidelines.  The building/Machine Room was not properly labeled to inform employees, contractors and emergency response personal of the presence of anhydrous ammonia and to restrict access; piping and components in the rooms were not properly labeled in accordance with industry standards, including the King valve; and the relief piping system routed some of the relief piping out the side of the building in a manner that could expose employees to ammonia vapors.

29 CFR  1910.151(c):  Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  Machine Room:  On, or about, July 13, 2021, emergency eyewash/safety shower units were not provided inside of the Machine Room and outside of the Machine Room.

29 CFR  1910.1200(h)(1):  Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  Company:  On, or about, August 19, 2021, information and training had not been provided to an employee who regularly entered the Machine Room to start the ice making equipment and who also conducted daily inspections and basic maintenance tasks of the anhydrous ammonia refrigeration system.
