29 CFR 1910.147(c)(1):Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. On or about July 14, 2021 the employer did not establish an energy control program consisting of energy control procedures, employee training, and periodic inspections. Employees were not protected from the unexpected energization, startup, or release of stored energy while performing servicing and maintenance activities (setup operations) on radial arm saws, vertical band saw machines, and table saws. Energy sources include, but not limited to electrical and energy.

29 CFR 1910.213(c)(1):Each circular hand-fed ripsaw shall be guarded by a hood which shall completely enclose that portion of the saw above the table and that portion of the saw above the material being cut. The hood and mounting shall be arranged so that the hood will automatically adjust itself to the thickness of and remain in contact with the material being cut but it shall not offer any considerable resistance to insertion of material to saw or to passage of the material being sawed. The hood shall be made of adequate strength to resist blows and strains incidental to reasonable operation, adjusting, and handling, and shall be so designed as to protect the operator from flying splinters and broken saw teeth. It shall be made of material that is soft enough so that it will be unlikely to cause tooth breakage. The hood shall be so mounted as to insure that its operation will be positive, reliable, and in true alignment with the saw; and the mounting shall be adequate in strength to resist any reasonable side thrust or other force tending to throw it out of line. On or about July 14, 2021, the employer did not ensure the point of operation (blade) of DELTA 10" tilting arbor saw was guarded with a blade hood or other guarding device to protect employees from having any part of their body contact the point of operation while operating the saw.

29 CFR 1910.215(b)(9):Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. On or about July 14, 2021, at a work place located at 12307 Broadway Ave, Garfield Heights, OH 44125, the employer did not ensure the distance between the wheel periphery and the adjustable tongue of RYOBI 8" Bench Grinder did not exceed one-fourth inch to protect employees from having any part of their body contact the point of operation while operating the Bench Grinder.

29 CFR 1910.1200(h)(1):Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. On or about July 14, 2021, at a work place located at 12307 Broadway Ave, Garfield Heights, OH 44125, the employer failed to ensure employees exposed to chemicals including but not limited to Xylene and Fister Form Seal, were provided effective information and training on hazardous chemicals in their work area
