29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On July 13, 2021, the Werner portable ladder used by employees to access and egress the trench, measuring approximately eight (8) feet in depth, was not long enough to have the side rails extend at least three (3) feet above the ground. No abatement certification or documentation is required for this item.

29 CFR 1926.652(b)(1)(i) Excavations shall be sloped at an angle not steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal), unless the employer uses one of the other options listed below. a) On July 13, 2021, employees were exposed to cave-in hazards while working in an excavation having a depth of approximately eight (8) feet. No abatement certification required for this violation. Copenhaver Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1170141, citation number 1, item number 1, and was affirmed as a final order on October 14, 2016, with respect to a workplace located at Lomond Drive and Beach Place in Mundelein, Illinois.
