29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  (a) On or about July 14, 2021, at a residential building site located at 14052 North Saddlewood Circle, Mequon, Wisconsin, employees conducting painting and plastering work were exposed to a fall hazards when climbing the crossbraces and scaffold uprights to access the working levels. This exposed employees to a fall hazard of  12 feet.

29 CFR  1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  (a)  On or about July 14, 2021, at a residential building site located at 14052 North Saddlewood Circle, Mequon, Wisconsin,  employees conducting painting and plastering work were exposed to a fall hazard while working on a scaffold that was not erected and inspected by a competent person. This exposed employees to a fall hazard of more than 12 feet.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  (a) On or about July 14, 2021, at a residential building site located at 14052 North Saddlewood Circle, Mequon, Wisconsin, employees conducted painting and plastering work while working on a scaffold without guardrails on all exposed side. This exposed employees to a fall hazard of more than 12 feet.
