29 CFR 1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met and which included the requirements outlined in 29 CFR 1910.1200(e)(1)(i)-(ii): (a) Location - 730 Main Street, Wilmington, MA: On or about July 13, 2021, a written hazard communication program describing the system(s) of practice used by the facility to label containers and provide information and training to employees on hazardous chemicals in their work area has not been developed. Additionally written materials supplied regarding hazard communication at the facility did not address: a list of hazardous chemicals known to be present at the workplace and the methods in place for informing employees of the hazards associated with chemicals contained in unlabeled pipes in their work areas.

29 CFR 1910.1200(e)(2): The employer that produced, used, or stored hazardous chemicals at the workplace in such a way that employees of other employer(s) could be exposed did not ensure that the hazard communication program included all of the elements outlined in 29 CFR 1910.1200(e)(2)(i) through 29 CFR 1910.1200(e)(2)(iii): (a) Location - 730 Main Street, Wilmington, MA: On or about July 13, 2021, a written hazard communication program describing the methods used by the facility to: provide other employer(s) on-site access to safety data sheets for each hazardous chemical the other employer(s)' employees may be exposed to while working, inform the other employer(s)' employees of any precautionary measures that need to be taken to protect employees during the workplace's normal operating conditions and in foreseeable emergencies, and inform the other employer(s) of the labeling system used in the workplace had not been developed.
