29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about July 14, 2021, the exposing employer, Brito Construction, LLC, did not ensure that each employee(s) engaged in residential construction activities 6 feet or more above lower levels were protected by guardrails, safety nets, or personal fall arrest systems. Employees of Brito Construction, LLC, who were required to engage in re-roofing operations on a two-story residential roof, were protected from exposure to fall hazards of eight feet and greater while engaged in residential framing activities. Employees were not using fall protection equipment.
