29 CFR  1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  At the jobsite located at 15810 W. 165th Street, Olathe, Kansas employees conducting framing operations were exposed to struck-by hazards in that head protection was not worn by employees who were working at a lower level and under an employee conducting framing work.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee was using eye or face protection when exposed to eye or face hazards from flying particles:  At the jobsite located at 15810 W. 165th Street, Olathe, Kansas employees conducting framing operations were exposed to struck-by hazards in that eye protection was not being used while using the pneumatic nail gun during framing operations.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  At the jobsite located at 15810 W. 165th Street, Olathe, Kansas, employees conducting framing operations were exposed to fall hazards of approximately 10 feet from upper level joist to the lower level of the residential in that fall protection system was not being used.  1) Employee working above the main door entrance, reaching over the edge to receive material to be installed, approximately 9 feet from the joist to the rock ground below.  2) Employee working on putting spacers between the trusses of the structure, approximately 10 feet from the joist to the lower level.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder was used as a step:  At the jobsite located at 15810 W. 165th Street, Olathe, Kansas, an employee was exposed to a fall hazard in that the top or top step of a Werner 8 foot stepladder was used to gain access to the upper level joist above the main entrance.
