OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while operating automotive lifts:  a) On or about July 16, 2021, and at times prior, the employer did not ensure that a vehicle lift with leaking hydraulic fluid was removed from service, repaired, and certified prior to the employees' use. The lift was causing uneven, tilting, and unstable balance of the vehicle on the lift. This condition potentially exposed employees to crushing  hazards.  Note: One feasible and acceptable method to correct this hazardous condition would be to follow the requirements in accordance to the instructions required in the ANSI/ALI ALOIM: 2008 Safety requirements for operation, inspection, and maintenance standards.

29 CFR  1910.303(b)(7)(i): Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings shall be effectively closed to afford protection substantially equivalent to the wall of the equipment:  a) On or about July 16, 2021, and at times prior, the employer did not ensure that several unused openings on the circuit breaker panel were effective closed. The circuit breaker panel located at the north side of the shop was accessed by the employees to power up the equipment and lights used at the shop area. This condition exposed the employees to possible electric shock when accessing the circuit breaker panel.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) On or about July 16, 2021 and at times prior, the employer did not develop and implement a written hazard communication program that conforms to the Globally Harmonized System prior to the employees' use and handling of chemicals. This condition potentially exposed employees to products that contain hazardous chemicals, including, but not limited to, A/C Pro R134a refrigerant,  X-tra seal rubber prep solution, Case Company liquid tire lube concentrate, Case Company bead sealer and various unknown, unlabeled chemicals.

29 CFR  1910.22(a)(3): The employer did not ensure that walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice:  a) On or about July 16, 2021, and at times prior, the employer did not ensure that the walking-working surface was free from  tripping hazards as a 2x4 electric outlet box was installed and sticking out from the floor in the break room. This condition exposed the employees to possible tripping hazards.

29 CFR  1910.37(b)(2): Each exit was not clearly visible and marked by a sign reading "Exit":  a) On or about July 16, 2021, and at times prior, two exit doors, one to the front and one to the rear of the shop were not marked with an exit sign. This condition exposed the employees to possible entrapment in the event of a fire emergency.
