29 CFR  1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for an employee, and did not comply with all other pertinent requirements of this subpart before that employee began the work that necessitates the fall protection:  a)	Dominion Terminal Associates: On or about 07/12/2021, an employee was tasked with welding the backside of a deflector plate without enough attachment points capable of supporting at least 5000 pounds, as a result disconnected his lanyard and fell approximately 20 feet.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.503(a)(2)(i):Employees were not trained, as necessary, by a competent person qualified to recognize the nature of fall hazards in the work area:  Dominion Terminal Associates: On or about 07/12/2021, an employee was not properly trained to recognize the nature of fall hazards in the work area in that the work area was not assessed to determine proper training and fall protection needed to prevent the fall hazard.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.503(b)(1):  The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training or  when employer relied on training conducted by another employer, the certification record needs to indicate the date the employer determined the prior training was adequate rather than the date of actual training, and the signature of the person who conducted the training or the signature of the employer:  a)	Dominion Terminal Associates: On or about 07/12/2021, the employer did not certify that fall protection training conducted on January 13, 2021, by CTR Corporation dba Government Services Group was adequate.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.502(d)(8):Horizontal lifelines were not designed, installed, and used under the supervision of a qualified person, as part of a complete personal fall arrest system, which maintained a safety factor of at least two:  a)	Dominion Terminal Associates: On or about 07/12/2021, the employer directed employees to erect and use a horizontal lifeline without qualified supervision. A 5/8 inch stainless steel cable was looped around a metal frame, extended above a walk board, looped through a pad-eye and fastened using three (3) U-bolt saddle clamps.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.502(d)(15)(i):  Anchorages used for attachment of personal fall arrest equipment were not designed, installed, and used as part of a complete personal fall arrest system which maintains a safety factor of at least two:  a)	Dominion Terminal Associates: On or about 07/12/2021, an employee attached his fall arrest lanyard to a padeye used in rigging the deflector plates.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
