29 CFR  1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed:  (a) At open pit along west side of excavation: The 8 foot Louisville folding step ladder that was used to enter the pit was used in the folded position rather than in the open position. The ladder was leaning against the top edge of the concrete wall at the midpoint of the ladder creating a tipping  potential.
