29 CFR 1910.176(a): Where mechanical handling equipment was used, sufficient safe clearances were not allowed for aisles, at loading docks, through doorways or wherever turns or passage had to be made: Warehouse: Powered industrial truck (forklift) operators were not afforded sufficient safe clearances in aisleways, loading docks and turn passages while operating powered industrial trucks. Consequently, On or About July 2, 2021, an employee was struck by a powered industrial truck.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely. Facility: On or about July 2, 2021, a powered industrial truck (forklift) operator was involved in an incident with another employee, where the employee was hit by the powered industrial truck resulting in serious injuries. The powered industrial truck (forklift) operator did not receive refresher training and an evaluation after the incident. The Connecticut Distributors, Incorporated was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1910.178(l)(l)(i) which was contained in OSHA Inspection Number 1388501, Citation Number 01, Item Number 003a, and was affirmed as a final order on September 23, 2019 with respect to a workplace located at 333 Lordship Boulevard, Stratford, CT 06615.
