29 CFR 1926.501(b)(1):Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system: a. At Building 13, on a new construction multi-family residential temporary worksite, on a 2nd floor unguarded balcony: On or about July 20, 2021, the employer exposed an employee to a 10-foot, 7-inch, fall hazard, in that fall protection was not utilized by an employee while installing exterior siding materials.
