On or about July 14, 2021, employees of Sunland Construction Inc. worked around the edge of an open excavation that was over six feet in depth with no barriers, guardrails, or personal fall protection.

A stairway, ladder, ramp, or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in-depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. On or about July 14, 2021, Southwest's side of the job site, employees observed in an excavation deeper than Four feet (4) feet in deep to install/repair a pipeline without a means of safe egress.

29 CFR 1926.652(a)(1): Each employee in the excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about July 14, 2021, employees were observed in an excavation greater than five (5) feet deep, where an eight (8) foot trench shield was placed in the excavation in conjunction with "benching" and "sloping" as a protective mechanism. According to Sunland Construction, the soil was classified as type "C" soil, which does not permit benching. Additionally, on the south and east side of the excavation, the bench and sloping had an inclination degree greater than forty-five degrees. Therefore, this protective system did not provide adequate protection for employees repairing/installing a pipeline.

On or about July 14, 2021, on the south side of the trenching area, employees worked inside an excavation greater than five (5) feet deep trench where the north side of the trench shield was not flush against the sidewall of the excavation.
