29 CFR  1926.102(a)(1):  The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  On or about July 20, 2021, at the jobsite, the employer did not ensure that employees were in use of eye protection while using pneumatic nail guns and hammers to install roof materials to the roof of a single story residential building.   This exposed the employees struck-by hazards.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  On or about July 20, 2021, at the jobsite, the employer did not ensure employees were in use of fall protection when performing roofing work activities from the roof of a residential building.  This exposed the employees to a fall greater than six (6) feet to the ground below.   Brinlaw Roofing & Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1467233, citation number 1, item number 1, and was affirmed as a final order on May 5, 2020, with respect to a workplace hazard at 16713, Oklahoma City, OK 73109.
