29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized crush by and struck-by hazards that were causing or likely to cause death or serious physical harm to employees. The employer is failing to protect employees from struck-by hazards related to using a skid steer on a construction site. This was most recently documented on July 19, 2021 at the jobsite located at 122 Longwood Drive, Papillion, Nebraska, where the employer has employees using the bucket on a Caterpillar Skid Model 249D skid steer to move a Load Trail, goose neck, triple axel trailer. The trailer tongue slipped off the bucket and punctured the cab of the skid steer resulting in serious injuries to the operator. LC Hardscapes, LLC: 122 Longwood Drive, Papillion, Nebraska - On July 19, 2021, an employee received a serious injury while attempting to move a trailer with the bucket of a skid steer. The trailer tongue slipped off the bucket and punctured the cab of the skid steer resulting in serious injuries. Among other methods, feasible and acceptable methods to correct this hazard includes, but are not limited to the following: i) Provide operator training to employees to address the hazards associated with operating skid steers per NIOSH Publication 2001-128, and ANSI B56.1 1969. ii) Follow the manufacturer's operating manuals for the Caterpillar Skid Steer and the Load Trail Trailer. iii) Develop and implement procedures to safely move trailers in and around jobsites.
