29 CFR  1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.  On or about July 21, 2021, and at times prior thereto, employees performing roofing activities on two separate buildings were not protected with hard hats after descending the roof to the ground, exposing the roofers to the hazard of being struck-by falling tools, materials and debris.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about July 21, 2021, and at times prior thereto, roofers were using pneumatic nail guns to perform roofing activities without the use of safety glasses, exposing the roofers to the hazard of being struck-by flying projectiles and particles to the eye(s).

29 CFR  1926.451(a)(6): Scaffolds were not designed by a qualified person.  On or about July 21, 2021, and at times prior thereto, wooden boxes were job-made and not designed by an engineer, did not have a rated capacity, and did not have the tare weight or center of gravity identified, exposing the personnel in the boxes and the operator to the hazard of being struck-by the box and the contents.

29 CFR  1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.   On or about July 21, 2021, and at times prior thereto, telehandler forklifts were used to support wooden boxes without being designed or engineered by the manufacturer for such use, exposing the personnel to the hazard of falling either over 30-feet or over 20-feet to the ground below.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  On or about July 21, 2021, and at times prior thereto, five roofers were performing roofing activities without using fall protection, exposing the roofers to a fall hazard of over 30-feet to the ground below.  MCM Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(10)), which was contained in OSHA inspection number 1401464, citation number 01, item number 01 and was affirmed as a final order on 07/25/2019, with respect to a workplace located at 2712 Satsuma Drive, Dallas, TX 75229.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  On or about July 21, 2021, and at times prior thereto, an aluminum extension ladder was used to gain access to the upper landing of the Protho Center without being extended at least 3-feet above, exposing the employees accessing the roof to a fall hazard.  MCM Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.1053(b)(1)), which was contained in OSHA inspection number 1401464, citation number 01, item number 02 and was affirmed as a final order on 07/25/2019, with respect to a workplace located at 2712 Satsuma Drive, Dallas, TX 75229.
