29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii) a) S & D Construction 2, LLC located at located at building 6, Highpointe Lakes Drive, WESTERVILLE, OH 43081: On and preceding July 20, 2021, the employer did not ensure that each platform on all working levels of scaffolds were fully planked or decked between the front uprights and the guardrail supports. A seven tier supported scaffold being utilized by masonry workers was only partially planked utilizing two, 2 x 10" planks between a 36" wide uprights leaving a 15-16" gap unplanked. The following condition exposed employees to falls in excess of 40 feet.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation: a) S & D Construction 2, LLC located at located at building 6, Highpointe Lakes Drive, WESTERVILLE, OH 43081: On and preceding July 20, 2021, a supported scaffold that was in use did not bear on base plates and mud sills or other adequate firm foundation. A seven tier supported scaffold which wrapped around three sides of a building was being utilized by masonry workers and did not have mud sills under all base plates. Many of the base plates had sunk into mud in deep puddles of water or had become displaced off of the mud sills which created an unstable foundation for the scaffold. The following condition exposed employees to falls in excess of 40 feet and struck-by hazards should the scaffolding collapse.

A seven tier supported scaffold which wrapped around three sides of the building was being utilized by masonry workers. Many of the base plates on all three sides of the scaffold had settled and sunken into mud or had become displaced off of the mud sills, creating an unstable foundation for the scaffold. The following condition exposed employees to falls in excess of 40 feet and struck-by hazards should the scaffolding collapse.

A seven tier supported scaffold which wrapped around three sides of the building was being utilized by masonry workers. Visible deflects including but not limited to sinking base plates and mud sills, missing guardrails, missing planking and missing toeboards were not identified and corrected before the scaffold was utilized. The following condition exposed employees to falls in excess of 40 feet and struck-by hazards should the scaffolding collapse.

Masonry workers were positioned on the fourth tier of a seven tier scaffold, approximately 25 feet high installing stucco netting on the building. The fourth tier and other sections of the scaffolding did not have guardrails or other means of fall protection installed which exposed employees to falls in excess of 40 feet at the upper tiers of the scaffolding.

A seven tier supported scaffold which wrapped around three sides of the building was being utilized by masonry workers. No toeboards of other protective measures were in place to ensure that employees on different tiers of the scaffolding or on ground level were protected from falling objects. The following condition exposed employees to struck-by hazards from tools and materials falling from the scaffolding.
