29 CFR  1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems: Note:  If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented.  On or about July 21,2021, observed an employee doing roofing work with no fall protection at a height greater than six (6) feet in height.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.   On or about July 21, 2021, on the south side of the construction site, the employee was utilizing a Werner 24 foot extension ladder that was not extended three (3) feet above the upper landing surface and not secured at any point.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.   On or about July 21, 2021,  employees did receive training on fall protection and fall hazards. Written records were not retained by the employer.
