29 CFR  1910.502(c)(2): The employer's COVID-19 plan was not in writing.   a) Dellridge Health & Rehabilitation Center, LLC located at 532 N Farview Ave, Paramus, NJ: On or about 07/21/2021 and thereafter, employees including, but not limited to, Licensed Practical Nurses (LPNs), Aides, and a Physical Therapist provided direct care to suspected and confirmed COVID-19 positive residents and patients. The employer did not have a written COVID-19 plan.

29 CFR  1910.502(i):The employer did not install cleanable or disposable solid barriers, when such barriers were feasible at each fixed work location outside of direct patient care areas where each employee is not separated from all other people by at least 6 feet of distance.  a) Dellridge Health & Rehabilitation Center, LLC located at 532 N Farview Ave, Paramus, NJ - Entrance / Lobby - Reception Desk: On or about 07/21/2021 and thereafter, employees including, but not limited to the receptionists who interact with the public, and incoming patients / residents  were potentially exposed to SARS-CoV-2, the virus that causes Coronavirus Disease 2019 (COVID-19). The employer failed to install cleanable or disposable solid barriers.

29 CFR  1910.502(k)(1)(iii): Employers did not ensure that all air filters are rated Minimum Efficiency Reporting Value (MERV) 13 or higher, if compatible with the HVAC system(s).    a) Dellridge Health & Rehabilitation Center, LLC located at 532 N Farview Ave, Paramus, NJ - Throughout the facility: On or about 07/21/2021 and thereafter, employees including, but not limited to, Licensed Practical Nurses (LPNs), Aides, and a Physical Therapist provided direct care to suspected and confirmed COVID-19 positive patients / residents. The employer failed to ensure that all air filters in the facility were rated Minimum Efficiency Reporting Value (MERV) 13 or higher. The employer used air filters rated MERV six and eight.
