29 CFR  1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a.  On or about July 19, 2021, at the above addressed jobsite, the portable ladder used to access the garage roof did not extend at least three (3) feet above the upper landing surfaces, thereby exposing employees to the hazards associated with falls.  b.  On or about July 19, 2021, at the above addressed jobsite, the portable ladder used to access the second story roof did not extend at least three (3) feet above the upper landing surfaces, thereby exposing employees to the hazards associated with falls.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a.  On or about July 19, 2021, at the above addressed jobsite, employees performing residential roofing operations, eighteen (18) feet ten (10) inches above the ground, were not protected from falls, thereby exposing the employees to fall hazards.  b.  On or about July 19, 2021, at the above addressed jobsite, employees performing residential roofing operations, nine (9) feet eight (8) inches above the ground, were not protected from falls, thereby exposing the employees to fall hazards.  ODT Construction, Inc. was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1454905, citation number 1, item number 1, and was affirmed as a final order on January 23, 2020, with respect to a workplace located at 933 N. Mitchell Ave. in Arlington Heights, Illinois.  ODT Construction Inc. was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1394845, citation number 1, item number 1, and was affirmed as a final order on August 20, 2019, with respect to a workplace located at 3060 Anton Cir. in Aurora, Illinois.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a. On or about July 19, 2021, at the above addressed jobsite, employees had been provided fall protection training, however, the employer failed to keep a written certification record of the training.
