OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:   a) At the worksite, 43 Goose Lane, Pennsville, NJ - Backyard: The employer failed to ensure the employee cutting the tree limbs and trunk positioned the aerial lift and felled the tree in a way to ensure that the sections being cut did not strike the lift (2006 GMC C7C Bucket Lift), on or about 5/24/2021.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The employer did not provide each employee with protective equipment for extremities such as, but not limited to leather chaps, on or about 5/24/2021.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. The employer did not conduct an assessment at this worksite to determine the hazards present, or are likely to be present, which necessitate the use of personal protective equipment, on or about 5/24/2021.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR  1910.138(a):The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes.  a) At the worksite, 43 Goose Lane, Pennsville, NJ - Backyard:  Employees were performing work tasks including, but not limed to felling trees, cutting felled tree limbs into smaller sections, and feeding tree sections into a wood chipper. The employer did not select or require the affected employees to use appropriate hand protection when employees' hands were exposed to the hazards from severe cuts or lacerations, abrasion, and puncture, on or about 5/24/2021.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
