29 CFR 1910.28(c)(3):The employer did not barricade the area into which objects could fall, prohibiting employees from entering the area, and keeping objects far enough away from an edge or opening to prevent them from falling to a lower level: Warehouse Area: On or about July 23, 2021, there were four instances of unstable stacking of pallets and materials in areas that employees access: a) Automobile radiators were stacked on top of a large box on the third tier of the storage rack, at an estimated height of 12 feet. b) Unstable pallets were stacked approximately 12 feet high, leading to a bathroom that employees use. c) Boxes leaning off a pallet on the third tier of a storage rack. d) A high pile of automobile radiators was observed with the bottom portion shrink wrapped and the top third loose and leaning.
