29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  Jobsite:  On or about July 23, 2021, five employees were not protected from falling to the ground while they were replacing a residential asphalt shingle roof.

29 CFR  1926.503(c):The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section:  (a)  Jobsite:  On or about July 23,, 2021, the company needs to retrain its employees in when and how to use fall protection so that they retain the knowledge of when and how to use fall protection when doing residential roofing work.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support:  (a) Jobsite:   On or about July 23, 2021, employees were using a ladder that only went about one foot above the edge of the roof.  The fall hazard ranged from about 8 to 13 feet.

29 CFR  1926.1060(b):The employer did not provide retraining as necessary so that each employee exposed to fall hazards maintained the understanding and knowledge acquired through initial training:  (a)  Jobsite:  On or about July 23, 2021, the five employees on the site, need to be retrained in how to properly set up and use ladders so that they minimize fall hazards when using ladders.
