29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. a. On or about July 19, 2021, an employee was operating an aerial lift to install siding on the exterior walls of a three story apartment building, during which time a restraint type body belt or a Personal Fall Arrest System was not worn by the operator and/ or the lanyard was not attached to the boom or basket; therefore exposing the employees to a fall hazard.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: a. On or about July 18, 2021, an employee was operating an aerial lift to install siding on the exterior walls of a three story apartment building while wearing a Personal Fall Arrest System (PFAS), wherein the system(s) were rigged such that during a fall, the employee would have free fallen more than 6 feet and/ or the system(s) were rigged such that the employee would have contacted the lower level; therefore exposing the employees to a fall hazard.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used. a. On or about July 18, 2021, an employee was operating an aerial lift to install siding on the exterior walls of a three story apartment building while wearing a Personal Fall Arrest System (PFAS), wherein the employer did not ensure that each employee had been trained, by a Competent person qualified in the use and operation of personal fall arrest systems, in subject areas such as PFAS limitations/ minimum fall height, and the nature of fall hazards in the work area, nor did the employer ensure that a Competent and Qualified person evaluated the fall protection knowledge and skills of trainees through written testing and performance assessments; therefore exposing the employees to a fall hazard.
