29 CFR  1926.502(d)(15): Anchorage points used for attachment of personal fall arrest equipment were not  independent of any anchorage point being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee:   a)  At 25624 West Perdido Ave., Building 8, Sandy Shores Village, Orange Beach, Alabama:  On or about July 29, 2021 and at time prior;  the employer allowed three employees to performing roofing activities using full body harnesses and tied off to a rope tied around the steeple portion of the roof exposing his employees to a fall hazard of 10 feet 8 inches to the ground below.

29 CFR  1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:   a)  At 25624 West Perdido Ave., Building 8, Sandy Shores Village, Orange Beach, Alabama:  On or about July 29, 2021 and at time prior;  the employer allowed his employees to performing roofing activities while tied off but with ropes pulled all the way out to the end of the rope exposing his employee to a fall hazard of up to 10 feet 8 inches to the ground below.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 25624 West Perdido Ave., Building 8, Sandy Shores Village, Orange Beach, Alabama:  On or about July 29, 2021 and at time prior;  the employer allowed his employees to work without fall protection while performing roofing activities exposing his employees to a fall hazard of 21 feet 3 inches to the ground below.  The EAE Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (B)(11), which was contained in OSHA inspection number 1422067, citation number 1, item number 2 and was affirmed as a final order on January 22, 2020, with respect to a workplace located at 2501 Stemley Bridge Rd., Pell City, Alabama.
