29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a)Empire Building Corporation at 201 West Willow Street in Harrisburg, SD 57032: On or about and at times prior to July 28, 2021, the employer did not ensure that employees were protected from fall hazards while operating aerial lifts. Employees operating JLG aerial lifts used to access the roof of commercial building under construction were not utilizing personal fall arrest systems within the basket. This condition exposed employees to fall hazards of approximately 17 feet while operating aerial lifts. Abatement Note: A personal fall arrest system is recommended with lanyard attached to the boom or basket when working from an aerial lift. As of January 1, 1998, Subpart M of the 29 CFR 1926 part, 1926.502(d) provides that body belts part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. (a)Empire Building Corporation at 201 West Willow Street in Harrisburg, SD 57032: On or about and at times prior to July 28, 2021, the employer did not ensure employees were protected from fall hazards when performing work at or near the edge of the roof by an appropriate fall protection system while installing metal roof decking. Employees relied on a warning line system that was not implemented in areas where employees performed work near the unprotected edge of the roof. This condition exposed employees to fall hazards of approximately 17 feet.
