29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) 4906 St. Stephens Road, Yard and warehouse areas; On August 2, 2021 and at times prior, the employer exposed employees to struck-by hazards, in that employees were allowed to operate forklifts without the employer first ensuring the employees were competent to operate the equipment as demonstrated by the completion of the required training and evaluation specified in the regulation.

29 CFR 1910.178(a)(6): Nameplates or markings for powered industrial trucks were not in place or were not maintained in a legible condition: a) 4906 St. Stephens Road, Yard and warehouse areas; On August 2, 2021 and at times prior, the employer allowed employees to operate a Hyster model H100XM forklift (SN L00V04967C), with an unreadable load chart/data plate. b) 4906 St. Stephens Road, Yard and warehouse areas; On August 2, 2021 and at times prior, the employer allowed employees to operate a Hyster model H500XM forklift (SN L005V05206C), with an unreadable load chart/data plate. c) 4906 St. Stephens Road, Yard and warehouse areas; On August 2, 2021 and at times prior, the employer allowed employees to operate a Hyster model H100XM forklift with a missing load chart/data plate. d) 4906 St. Stephens Road, Yard and warehouse areas; On August 2, 2021 and at times prior, the employer allowed employees to operate a Toyota model 42-6FGCU25 forklift (SN 7178), with an unreadable load chart/data plate.
