29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about August 2, 2021, and at times prior, the employer had not initiated and maintained programs to protect employees from the hazards associated with painting and refinishing construction work. The programs included, but were not limited to, fall prevention, ladder safety, personal protective equipment, pressure-washing safety, and respiratory protection.

29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. On or about August 2, 2021, and at times prior, the employer did not instruct employees on information such as, but not limited to, ladder safety, fall prevention/protection, personal protective equipment, and pressure-washing safety. As a result, employees were exposed to hazards such as, but not limited to, struck-by and falls from heights.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about August 2, 2021, and at times prior, employees were pressure-washing the exterior of a building without utilizing eye protection. As a result, employees were exposed to being struck-by high-pressure water into the eye.

29 CFR  1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a. On or about August 2, 2021, and at times prior, an employee was performing pressure-washing at an unprotected edge of the roof of a Wendy's restaurant without any fall protection measures in place. As a result, the employee was exposed to a fall hazard of approximately fifteen feet.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. On or about August 2, 2021, an employee utilized a portable Werner aluminum extension ladder to access the roof of the Wendy's to perform pressure-washing work. The ladder in use did not extend at least three feet above the upper landing surface, nor were other acceptable measures utilized. As a result, the employee was exposed to a fall hazard of up to fifteen feet.
