29 CFR 1910.28(b)(2)(i): The employer did not ensure that each employee in a hoist area is protected from falling 4 feet (1.2 m) or more to a lower level by one of the systems listed in 29 CFR 1910.28(b)(2)(i)(A)-(C).  a. On or about July 31, 2021, at the above addressed facility, an employee, performing maintenance operations on staff elevators #19 and #20, entered the hoistway area and was not protected from falling approximately sixteen (16) feet to the lower level, thereby exposing the employee to fall hazards.

29 CFR 1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard.  a.  On or about July 31, 2021, at the above addressed facility, an employee was required to access the elevator shaft to conduct maintenance activities on elevator banks #19 & #20.  The employee was exposed to struck by hazards and fall hazards when the elevator doors were open for the employee to gain access to the top of the elevators.

29 CFR  1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  a. On or about July 31, 2021, at the above addressed facility, the employer had a written energy control program, but did not conduct an annual periodic inspection of the program, thereby exposing an employee to struck-by hazards and fall hazards when performing maintenance operations.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):(a)  a)  On or about July 31, 2021, an employee was exposed to machine hazards associated with moving parts when elevator #19 and #20 were not locked out, which resulted in a fatality.  The employer failed to implement energy control application steps as the elevators were not shut down or turn off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from servicing hazards.
