29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a)Arturo Reyes at 526 Abraham Court in Rapid City, SD 57703: On or about and at times prior to July 28, 2021, the exposing employer did not ensure employees installing roof sheathing were protected from fall hazards. Employees were installing roof sheathing without the use of an appropriate fall protection system. This condition exposed one employees to a fall hazard of  approximately 10 feet.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  (a)Arturo Reyes at 526 Abraham Court in Rapid City, SD 57703: On or about and at times prior to July 28, 2021, the exposing employer did not ensure a written fall protection training certification was prepared which included the identities of employees trained, dates of training, and the signatures of the trainer or employer. An employee installing roofing sheathing without the use of a fall protection system. This condition exposed an employee to a fall hazard of  approximately 10 feet.  Abatement Note: The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.
