29 CFR  1910.253(b)(2)(iv):  Valve protection caps, where cylinders were designed to accept caps, were not always in place, hand-tight, except when cylinders were in use or connected for use.   a.  On or about July 16, 2021, near the tank farm, the employer did not ensure that a valve protection cap was installed on an oxygen cylinder that was not in use and was stored in a truck bed.  This exposed the employees to fire and explosion hazards.  b.  On or about July 16, 2021, near the tank farm, the employer did not ensure that a valve protection cap was not installed on a acetylene cylinder that was not in use and was stored in a truck bed compartment.  This exposed the employees to fire and explosion hazards.

On July 16, 2021, for the tank farm, the employer did not develop and implement a written hazard communication program which described how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  Employees were exposed to hazardous chemicals present at the tank farm including, but not limited to crude oil,  condensate, tire oil, gas oil, surfactants, emulsion breakers, Solvent, compressed oxygen, and acetylene.

29 CFR  1910.1200(f)(6)(ii):  Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.    On or about July 21, 2021, behind the tank farm office, the employer did not ensure a 55 gallon container of oil was labeled, tagged, or marked with the product identifier and words, pictures, symbols, or combination thereof to provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  This exposed the employees to hazardous chemicals.

29 CFR  1910.1200(f)(7):  The alternative method in lieu of affixing labels to individual stationary process containers did not identify the container to which it is applicable and did not convey the information required by 29 CFR 1910.1200(f)(6).  On or about July 17, 2021, at the tank farm, the employer did not ensure that the sign of hazard warnings that was used in lieu of affixing labels to tanks containing crude oil, condensate, tire oil, and gas oil, conveyed the information required by 29 CFR 1910.1200(f)(6) and lacked:         a.  Flammability hazard warnings      b.  Irritation hazard warnings      c.  Toxicity hazard warnings      d.  Identifying the tanks applicable to the posted hazards      e.  Identification of tank contents.  This exposed employees to the hazardous chemicals.
