29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level (TWA) of 85 dBA: On or about August 04, 2021, and at times prior thereto, at a workplace located at 1172 US Hwy 385 N., Seminole, Texas; employees were exposed to continuous noise level at 130.1% of the allowable 8-hour time-weighted average sound level (85 dBA). The equivalent dBA level of 130.1% is approximately 91.9 dBA. The sampling was performed for 426 minutes during one shift on August 12, 2021. Zero exposure was assumed for the 54 minutes not sampled.

29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about August 04, 2021, and at times prior thereto, at a workplace located at 1172 US Hwy 385 N., Seminole, Texas; employees cleaning drum sizer gearheads were exposed to arm and/or hands entering into point of operation of the machine during the operation cycle due to insufficient point of operation guard installed on gearhead of the drum sizer.
