On or about August 2, 2021, the employer did not perform annual periodic inspections to ensure that documented lockout/tagout procedures were being followed by employees and that the procedures were effective. The employees were thereby exposed to hazards associated with rotating and moving parts.

29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees: a. On or about August 2, 2021, on the G-Zilla Line #1, the employer failed to provide adequate training to each employee performing service and/or maintenance activities to ensure the knowledge and skills required for the safe application, usage and removal of energy control devices were adequate. A machine operator was impaled in the chest by the machine's auger while attempting to place the lid onto the end of the horizontal screw conveyor (kernel dispensing tube).

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): a. On or about August 2, 2021, on the G-Zilla Line #1, employees were exposed to machine hazards associated with moving parts while placing the lid onto the end of the horizontal screw conveyor (kernel dispensing tube), which resulted in the impalement of the G-Zilla Line #1 auger through the employee's chest and exit through the back. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)((i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.
