29 CFR  1926.102(a)(1):Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:  a) Andes Martinez locate at Lot 64 & 65 Ludwig street, Powell, OH 43065: On and preceding August 5, 2021, the employer did not ensure that eye protection was provided and utilized by framers using pneumatic nail guns and other power tools to install trusses, sheathing and other framing pieces.  The following condition exposed the employees to struck-by hazards to the eyes and face.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Andes Martinez locate at Lot 64 & 65 Ludwig street, Powell, OH 43065: On and preceding August 5, 2021, the employer did not ensure that employees were protected from falls while working on trusses and open sided floors that were more than 6 feet above the lower level. Framers were exposed to falls up to 22 feet when installing trusses and other framing pieces near open sided floors without utilizing any form of fall protection.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a) Andes Martinez locate at Lot 64 & 65 Ludwig street, Powell, OH 43065: On and preceding August 5, 2021, the employer did not ensure that ladders being used for access to an upper surface extended at least three feet beyond the upper landing being accessed.  Framers utilized 8 foot A-Frame ladders to access the second floor and trusses which were 9-10 feet above the lower level which exposed the workers to falls up to 10 feet.
