OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. SUNRISE SKI RESORT: The employer did not prohibit employees from riding in, and working from the bucket of a Caterpillar 966F loader (SN YG00321), exposing the employee to fall and struck by hazards as observed on August 5, 2021.

29 CFR 1926.102(a)(2): The employer did not ensure that each affected employee used eye protection that provided side protection when there was a hazard from flying objects. Detachable side protectors (e.g. clip-on or slide-on side shields) meeting the pertinent requirements of this section are acceptable. SUNRISE SKI RESORT: An employee grinding on a metal sign was not wearing safety glasses or googles with side protectors, exposing them to eye injury from flying objects.
