29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  Site - On or about August 9, 2021, the employer did not perform frequent and regular inspections by a competent person to identify hazards at the jobsite where employees were exposed to falls of over 20 feet while not utilizing fall protection, eye injuries while not utilizing eye protection and struck-by hazards while not utilizing head protection.  The Best Construction Corp. was previously cited for a repeat violation of this occupational safety and health standard 1926.20(b)(2), which was contained in OSHA inspection number 1415786, citation number 2, item number 1 and was affirmed as a final order on November 25, 2019, with respect to a workplace located at 21-28 Cate St. in Portsmouth, NH.  The Best Construction Corp. was previously cited for a violation of this occupational safety and health standard 1926.20(b)(2), which was contained in OSHA inspection number 1345061, citation number 1, item number 1a and was affirmed as a final order on November 16, 2018, with respect to a workplace located at 1179 Sagamore Ave. in Portsmouth, NH.  Note: Since 2018, The Best Construction Corporation has been inspected 4 other times where OSHA has issued citations (25 total violations including 4 Repeat). The company has been cited for not performing site inspections twice previously, with one repeat violation issued in inspection 1415786. On this jobsite (118 Maplewood Ave, Portsmouth, NH), the employer was not adhering to the previously agreed upon terms of the OSHA Inspection 1415786 Settlement Agreement where a safety & health program which provided for frequent and regular site inspections had not been implemented and employees were again working unprotected while a company foreman observed, oversaw, and failed to correct their unsafe work practices.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  Jobsite - On or about August 9, 2021, where an extension ladder was being used for access to and from the roof on the back side of the building, the ladder side rails did not extend at least 3 feet above the upper landing surface, exposing employees to a fall of over 21 feet.   The Best Construction Corp. was previously cited for a repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1415786, citation number 2, item number 4 and was affirmed as a final order on November 25, 2019, with respect to a workplace located at 21-28 Cate St., Portsmouth, NH.  The Best Construction Corp.  was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1327994, citation number 1, item number 1d and was affirmed as a final order on September 10, 2018, with respect to a workplace located at 18 Waterford Way, Pelham, NH.  Note: Since 2018, The Best Construction Corporation has been inspected 4 other times where OSHA has issued citations (25 total violations including 4 Repeat). The company has been cited for utilizing access ladders that were not extended at least 3 feet above a landing surface two other times, with one repeat issued in inspection 1415786. On this jobsite (118 Maplewood Ave, Portsmouth, NH), the employer was not adhering to the previously agreed upon terms of the OSHA Inspection 1415786 Formal Settlement Agreement where employees were again utilizing ladders not extended 3 feet above the landing surface while a company foreman observed, oversaw, and failed to correct their unsafe work practices.
