29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) Excavation in Front Yard and Parallel to St. Johns Road - An employee worked in the excavation, dug in Type B soil, to install a sewer line cleanout pipe near the road. The employer did not keep the pile of soil dug from the excavation and placed along the western wall at least two feet from the edge of the excavation nor use retaining devices to keep the material from falling into the excavation and striking the employee working in the excavation, on or about August 3, 2021. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: a) Excavation in Front Yard and Parallel to St. Johns Road - The employer did not have a competent person on the job site in that none of the employees who worked on the site on August 3, 2021 inspected the job site, identified predictable trenching and excavation hazards, and took immediate actions to correct the hazards. As a result, an employee worked in an unprotected trench, dug in Type B soil at best, ranging from 5 feet 10 inches to 6 feet deep, to install a sewer line cleanout pipe near the road. In addition, this 10-foot long by 3-foot 8-inch wide trench did not have the excavated soil pile at least 2 feet back from the edge along the western wall and had a 6-foot step ladder, used in the folded position and not extending 3 feet above the trench's top surface, for access, exposing employees to cave-in, struck-by, and fall hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

This 10-foot long by 3-foot 8-inch wide trench ranged from 5 feet 10 inches to 6 feet deep and had unprotected vertical side walls, exposing the employee to a cave-in hazard, on or about August 3, 2021. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
