29 CFR  1910.134(g)(1)(i)(B): Respirators with tight-fitting facepieces were worn by employees with a condition that interfered with the face-to-facepiece seal or valve function:(a)    Generations at Neighbors, LLC, 500 Hall located at 811 West 2nd Street, Byron, Illinois:  On or about August 10, 2021, tight fitting respirators were worn by employees in a way that interfered with the face to facepiece seal.  An unvaccinated CNA (Certified Nursing Assistant) entered the room of a PUI (Person Under Investigation for COVID-19) wearing an N95 respirator with only one strap around the head, while the other strap was hanging, thereby reducing the protective effect of the N95 respirator.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.502(f)(2)(i): a respirator to each employee and ensure that it is provided and used in accordance with � 1910.134    Generations at Lincoln, LLC, 500 Hall located at 811 West 2nd Street, Byron, Illinois:  On or about August 10, 2021, tight fitting respirators were worn by employees in a way that interfered with the face to facepiece seal. 29 CFR  1910.502(c)(4)(ii):In order for an employer to be exempt from providing controls in a well-defined area under paragraph (a)(4) of this section based on employees' fully vaccinated status, the COVID-19 plan must include policies and procedures to determine employees' vaccination status.  On or about August 10, 2021, the employer, Generations at Neighbors, LLC, did not include policies and procedures in the COVID-19 plan that determine employees' vaccination status.   With less than 40% of the staff vaccinated, the employer was not exempt from providing controls, including but not limited to "physical distancing" and "physical barriers" at areas such as but not limited to the Main Nurses' Station and the Patients Under Investigation (PUI) Nurses' Station in the 500 Wing of the Facility.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.502(i):Physical barriers.  At each fixed work location outside of direct patient care areas (e.g., entryway/lobby, check-in desks, triage, hospital pharmacy windows, bill payment) where each employee is not separated from all other people by at least 6 feet of distance, the employer must install cleanable or disposable solid barriers, except where the employer can demonstrate it is not feasible.  The barrier must be sized (e.g., height and width) and located to block face-to-face pathways between individuals based on where each person would normally stand or sit. The barrier may have a pass-through space at the bottom for objects and merchandise.  On or about August 10, 2021, the employer failed to ensure that unvaccinated healthcare providers were separated from other nursing home staff by physical barriers at fixed workstations.     a) Generations at Neighbors, LLC did not install physical barriers at the main nurses' station. On or about July 21 through July 30, 2021, the employer failed to ensure that all air filters are rated Minimum Efficiency Reporting Value (MERV) 13 or higher.
