29 CFR 1910.176(a): Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. On or about August 10, 2021 in Receiving, the employer did not ensure that a clearly marked aisle was kept clear and in good repair, without obstructions across or in by materials where mechanical handling equipment was operated, exposing employees to struck by or caught between hazards.

29 CFR 1910.178(l)(6): The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. On or about June 10, 2021, the employer had not certified that one employee had been trained and evaluated as required by paragraph (l) to operate the Aisle Master. The employee was observed operating Aisle Master Model 33NE (SN 52271) during the inspection.
