On or about July 28, 2021, an employee who had recently been involved in an accident while operating a forklift, was operating a forklift to lift/ move palletized loads of materials/ merchandise, during which the employer failed to ensure that the operator of forklift had received post-accident refresher training and a performance evaluation, after the operator had been involved in an accident; therefore exposing the employees/ operators of the other forklifts and also exposing the employees/ pedestrians in the warehouse to a struck-by hazard.
