29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedure) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):   (1) prepare for shut down by recognizing energy hazards and its controls,  (2) turn off and shut down the machines,  (3) physically locate and operate energy isolating devices in such a manner as to isolate the machine or equipment from the energy source,  (4) affix lockout or tagout devices to each energy isolating device,  (5) render safe all potentially hazardous stored or residual energy,  (6) verify that isolation and de-energization of the machine or equipment have been accomplished.   Press brake area, Cincinnati 90 ton hydraulic press brake (serial no. 50113) - on or about July 30, 2021, the employer did not ensure that press brake operators had isolated the hazardous energy prior to reaching into the point-of-operation and its associated danger zone to adjust back gauge fingers. Because the equipment was not locked out, employees had their hands exposed to an unguarded pinch point resulting in serious crushing injury.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle:  Press brake area, Cincinnati 90 ton hydraulic press brake (serial no. 50113) - on or about July 30, 2021, press brake operators were assigned to hand-feed, align, and support parts for close-proximity single and multiple bends in the unguarded point-of-operation. Operators had their fingers and hands exposed to the pinch point hazards during the foot-pedal initiated operating cycle because safeguards were not provided.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
