29 CFR 1910.178(l)(6):Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. a) On or before August 11, 2021, employees were operating a Genie GTH-844 Telehandler forklift in that the employer failed to certify that each employee had been trained, evaluated, and the person who performed the training or evaluation to operate the forklift.

29 CFR 1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or before 08/11/2021, located on the north side of a residential construction site, employees were operating a Genie GTH-844 Telehandler forklift as there were no frequent or regular inspections performed by a competent person designated by the employer to ensure employees were not exposed to electrical hazards while operating the forklift between the 7.2 kV primary and secondary overhead power lines.

29 CFR 1926.416(a)(1):No employer shall permit an employee to work in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work, unless the employee is protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means. a) On or before 08/11/2021, located on the north side of a residential construction site, an employee was exposed to electrical hazards of 7.2 kV operating a Genie GTH-844 Telehandler forklift to raise the material to the second floor while extending the boom between the primary and secondary overhead power lines.
