29 CFR 1926.102(a)(1):Eye and face protective equipment were not used when machines or operations presented potential eye or face injury: a) New residential construction, Lot 7, Roof: On or about 8/12/2021, the employer exposed an employee conducting framing activities to struck-by hazards , in that he was operating a Pneutools SN22/83H framing nail gun at 80 PSI without eye protection.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction, LOT 7, Roof: On or about 8/12/2021, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were conducting framing activities on the second story of a flat roof at heights measured at 11 feet to the lower level. Employees were preparing to frame the second floor of the new residential construction.
