OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to physical threats and assaults by patients: (a) Location - Lowell General Hospital, Saints Campus, Behavioral Health Holding Area: On or about July 31, 2021, and at times prior, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to physical threats and assaults by patients who exhibited aggressive behavior and were known to pose a risk to themselves and others. Employees, including but not limited to registered nurses (RNs) were exposed to physical and verbal threats of assault while providing patient care and performing administrative duties, and while aiding other employees who were being assaulted. Employees were exposed to physical assaults including hitting, kicking, and striking with objects resulting in head injuries, back injuries, hip injuries, and finger fractures while performing their job duties. The employer had not developed and implemented adequate measures to protect employees from this recurring serious hazard.
