29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: FormTight, Inc. 11600 E 51st Ave, Denver, CO 80239: On or about October 19, 2021, the employer did not develop and implement a noise monitoring program, thus potentially exposing employees assigned/tasked with working in the grinding room to excessive noise levels. a) Operator 1 was exposed to a dose of 450.0% (10-hour time weighted average of 99.1dBA) for a 602 minute sampling. The operator was exposed to noise levels that exceed a 10-hour time-weighted average of 83.4 decibels. b) Operator 2 was exposed to a dose of 132.8% (10-hour time weighted average of 90.3dBA) for a 603 minute sampling. The operator was exposed to noise levels that exceed a 10-hour time-weighted average of 83.4 decibels. These exposures occurred on extended work shifts of around 10 hours, which resulted in adjusted action levels of 83.4 dBA . The adjusted action level is used instead of the 85 dBA level when shift length exceeds 8 hours.

29 CFR 1910.95(g)(1):The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: FormTight, Inc. 11600 E 51st Ave, Denver, CO 80239: On or about October 19, 2021, the employer's audiometric testing program was inadequate in that audiometric tests were not given to every employee at risk of overexposure to noise. a) Operator 1 was exposed to a dose of 450.0% (10-hour time weighted average of 99.1dBA) for a 602 minute sampling. Employees in the grinding room area were exposed to noise levels that exceed an 10-hour time-weighted average of 83.4 decibels. b) Operator 2 was exposed to a dose of 132.8% (10-hour time weighted average of 90.3dBA) for a 603 minute sampling. Employees in the grinding room area were exposed to noise levels that exceed an 10-hour time-weighted average of 83.4 decibels. Use of dust masks is voluntary however; the employer failed to provide a copy of and to educate employees on the information contained in Appendix D, thus exposing employees to physiological stress hazards.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier, signal word, hazard statement(s), pictogram(s), precautionary statement(s) and name, address, and telephone number of the chemical manufacturer, importer, or other responsible party: FormTight, Inc. 11600 E 51st Ave, Denver, CO 80239: On or about August 11, 2021, the employer failed to ensure that chemicals used at the facility were properly labeled. Unlabeled chemicals used at the site include but are not limited to the following: a) Employees tasked with working near and/or around the rotary thermoformer machinery were exposed to chemical hazards in that spray bottles containing a clear liquid marked denatured alcohol and food grade silicone were not marked and/or properly labeled with product identifiers and hazard warning information for the contents within. b) Employees tasked with working near /around three 5 gallon buckets that were placed under the employer's thermoformer machinery that contained a green liquid with no labelling were exposed to chemical hazards in that, the secondary container were not provided with a label nor were the marked with product identifiers and hazard warning information for the contents within. c) Employees tasked with working near /around one 5 gallon bucket and a clear pitcher that were placed on the ground near a thermoformer that contained a green and clear liquids with no labelling and improper labelling were exposed to chemical hazards in that, the secondary container were not provided with a label nor were the marked with product identifiers and hazard warning information for the contents within.
