29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. (a) On or about August 16, 2021, the employer had not trained employees on the globally harmonized system and the new elements of labeling and safety data sheets that was required to be completed by December 1, 2013.

29 CFR 1910.1200(h)(3)(iii): Employee training shall include at least: The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; (a) Employees who worked directly with the Univar Blend Lacquer Thinner (a custom blend for Flexoplate) were not aware that the mixture contained carcinogenic material and were not required to wear eye protection or chemical resistant gloves while using thinner. (b) Employees working in the building where the plate making department was located were not informed of the irritant properties of the chemicals in plate making and possible sensitivity caused by methyl methacrylate contained in the AV CORR MLR. (c) Employees working in plate making were not informed of the irritant and sensitizing hazards of the plate making chemicals, such as but not limited to Univar Blend Lacquer Thinner-irritant, skin eye damage, carcinogen, Washout Solution HO-corrosive to eyes, skin irritant , AVantage Liquid Developer-harmful if swallowed, AV CORR MLR-skin irritation, serious eye irritation, may cause allergic skin reaction, Letterflex 180SP irritation of eyes, skin, nose and throat, nausea, headaches, AVantage Salt-irritant to eyes, skin, respiratory, Post Exposure Salt irritation of eyes and skin, AV PLATEWASH+ADD-combustible, skin, eye, respiratory irritation, may be fatal if swallowed, AV Solve II + Solution-harmful inhalation, may be fatal if swallowed, and did not wear appropriate personal protective equipment, such as eye and face protection and protective gloves.
