29 CFR 1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) On or about August 13, 2021 and at times prior thereto, the employer failed to develop and implement a written respiratory protection program in accordance with the requirements of 29 CFR 1910.134(c) to protect the employee performing mixing operations from hazardous exposures to respirable PNOR in the workplace. Results of air sampling conducted by CSHO on August 18, 2021 indicated one exposure to respirable PNOR at 1.928 times the permissible exposure limit.

29 CFR 1910.1000(a)(2):Employee(s) were exposed to an airborne concentration of particulates not otherwise regulated (PNOR) respirable fraction and total dust listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration (5 milligrams per cubic meter of air): (a) On or about August 18, 2021, a mixer employee was exposed to particulates not otherwise regulated (respirable fraction) at an eight-hour time-weighted average of 9.6 milligrams per cubic meter of air, approximately 1.93 times the PEL of 5 milligrams per cubic meter of air. Sampling was performed for 537 minutes. Zero exposure was assumed for the un-sampled time of 60 minutes.
