29 CFR 1910.178(p)(1): A powered industrial truck was found to be in need of repair, defective, or in any way unsafe, the truck and was not be taken out of service until it had been restored to safe operating condition. On or about 8/16/2021, Grey Eagle Distributors had not ensured that each powered industrial truck in need of repair, defective, or in any way unsafe was not be taken out of service until it had been restored to safe operating condition. The following powered industrial trucks were defective and not removed from service: a) Hyster Model J40SNT, Serial # 591; the seatbelt was tied around the armrest preventing the restraint system from properly operating. b) Hyster Model J40SNT, Serial # 566; the seatbelt was pulled out and tied in a knot preventing the restraint system from properly operating. c) Hyster Model J40SNT, Serial # 543; the seatbelt was pulled out and tied in a knot preventing the restraint system from properly operating.
