29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards that  enabled each employee to recognize the hazards of falling  train each employee in the procedures to be followed in order to minimize these hazards:   On or about August 11, 2021, an employee was exposed to a fall hazard greater than 6 feet , while attaching wood framing members to a roof, without being trained in the hazards of a fall.

29 CFR  1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer did not develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502:  On or about August 11, 2021, an employee was exposed to a fall hazard greater than 6 feet , while attaching wood framing members to a roof, without using fall protection.  The subcontractor, George Barbosa, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1197606, citation number 1, item number 2, and was affirmed as a final order on January 31, 2017, with respect to a workplace located at 26322 Florencia Villa, Boerne, TX, 78015.
